On 11 March 2009 misleading or deceptive proceedings were filed in the Federal Magistrates Court - Brisbane file number : BRG 167/2009. The proceedings identified Mr. Owen as the second respondent. |

On 11 March 2009 a Certified Business Names Extract for RED E CREATIONS revealed the principle place of business and postal address for Gary Eryl Roy Owen as being 7 Kardina Court, Karana Downs Qld 4306. |

That address subsequently turned out to be false and a process server was unable to serve documents. |

|
On locating and telephoning his University of Queensland (UQ) work number 07 3240 5812 on 3 April 2009 he verbally refused to provide an address for personal service on him. |

His exact location in a UQ unit in the Princess Alexander Hospital in Brisbane could not be ascertained as he would not reveal it and other staff members said that they did not know him. |

Copies of the original court documents were emailed to him at the following 3 addresses that were known to belong to him g.owen@uq.edu.au, gary@redecreations.com and gowenhouse@yahoo.co.uk the latter 2 being email contacts for his redecreations.com domain and his other bogus florist domains of PickoftheBunch.com.au, BloomingLovely.com.au and floristnz.org.nz. None of the emails bounced. |

| An Internet Relay Florist (also known as an Order Gatherer) is
essentially a website where a person or organisation with sophisticated
computer operation/s in a remote (often undisclosed or overseas)
location, using sophisticated website technology that sometimes
may include potential or arguable misrepresentation and using stock
photography which is often not their own or imitation flowers (as
they are often not real florists), procures a purchase order between
a consumer and itself, and then to fulfill the order relays it to
a local florist in the delivery area (the Supplier Florist) minus
a substantial commission retained by the Relay Florist. Commissions
can be up to 80% In short, this conduct is hi-jacking a consumer order to a Supplier Florist, then selling it back to the Supplier Florist minus commissions which are often aggregated by the amount of other Relay Florists and/or Affiliates involved in handling a particular order. Further, during provision of the order and its delivery, the hi-jacker normally relinquishes any quality control of the product it has sold, and then defends any misrepresentation claims or complaints by way of its "substitution policy" and other onerous terms buried within its terms & conditions. |
